About Adam R. Prescott

Adam R. Prescott is a shareholder at Bernstein, Shur, Sawyer & Nelson, PA in Portland, Maine, where he represents businesses and individuals in bankruptcy, out-of-court restructurings, and other complex transactional and litigation matters, with an emphasis on chapter 11 cases. Adam has represented chapter 11 debtors and post-confirmation trustees in cases filed in numerous jurisdictions, including recent matters in bankruptcy courts in Maine, Massachusetts, Vermont, Ohio, Texas, and Delaware. Adam’s chapter 11 practice includes representing businesses in a diverse array of industries, such as health care, manufacturing, transportation, energy, real estate development, hospitality, and retail, and he has represented numerous small business debtors in successfully reorganizing under the Small Business Reorganization Act of 2019 (Subchapter V).

In addition to his chapter 11 debtor practice, Adam has represented secured lenders, unsecured creditors’ committees, debtor-in-possession lenders, asset purchasers, landlords, trade vendors and other interested parties throughout all stages of chapter 11 and 7 cases, as well as litigating preference actions, fraudulent transfer lawsuits, and bankruptcy appeals.

Adam is a frequent contributor to the national and regional discourse regarding bankruptcy law and practice, especially recent developments regarding Subchapter V. Adam has authored several articles on a variety of Subchapter V topics and case law developments, including in the ABI Journal, the Norton Journal of Bankruptcy Law and Practice, the Maine Bar Journal, and Law360. He also has presented on Subchapter V and other bankruptcy topics at the ABI Annual Spring Meeting and ABI Northeast Conference, as well as speaking as a witness on Subchapter V eligibility issues at the ABI Subchapter V Task Force’s June 23, 2023 public hearing, among numerous other national webinars and panels. In 2022, Adam participated as a member of the 2022 class in the Next Generation program at the National Conference of Bankruptcy Judges, and in 2023, he was selected for ABI’s 40 Under 40 award, which recognizes the top 40 insolvency industry professionals under the age of 40. Adam has been selected in both Chambers USA for Bankruptcy/Restructuring and Super Lawyers New England.

Prior to joining Bernstein Shur, Adam was a senior associate at WilmerHale in Washington, D.C., and he clerked for the Hon. Rudolph Contreras of the U.S. District Court for the District of Columbia. Adam graduated summa cum laude from the William & Mary School of Law in 2012, and received his undergraduate degree from Trinity College in Hartford, Connecticut.
